The contractor must deliver the equipment within 90 days of the contract award. Documentation requirements include operator and service manuals, and the warranty agreement. Payment will be a firm-fixed price, processed monthly via the U.S. Treasury’s IPP system upon receipt of complete and accurate invoices. The government retains liability for contractor omissions or negligence, and no information from the contract can be released without Contracting Officer concurrence. Federal regulations supersede contractor terms and conditions in case of conflict. Only the Contracting Officer has the authority to bind or modify the contract.
    The Indian Health Service (IHS) requires offerors to self-certify their status as an “Indian Economic Enterprise” (IEE) under the Buy Indian Act (25 U.S.C. 47) when responding to solicitations, sources sought, or requests for information. This certification must be maintained from the time of offer submission through contract award and for the entire performance period. If eligibility is lost, the contractor must immediately notify the Contracting Officer. Contracting Officers may request documentation to verify eligibility, and awards may be protested if an offeror’s eligibility is questioned. In addition to self-certification, successful offerors must be registered with the System for Award Management (SAM). Providing false or misleading information is a violation of law, punishable under 18 U.S.C. 1001, with false claims during performance subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The form requires the offeror to represent whether they meet the IEE definition and includes fields for ownership details, certifying signature, tribal entity name, business name, and DUNS Number.
