    The National Institute of Standards and Technology (NIST) has issued a special notice regarding the NIST Terms of Service (TOS) Addendum. This Addendum is incorporated into any terms of service, end-user license agreements, or software license agreements intended to create binding obligations on NIST or NIST employees acting in an official capacity.

    The purpose of the NIST Addendum is to establish certain provisions and requirements for agreements involving NIST. It covers various aspects such as the governing laws, dispute resolution, indemnification and warranties, intellectual property, confidentiality, audits, additional terms, obligations and taxes, non-assignment, precedence and survival, and duration of the agreement.

    This notice ensures that any agreement entered into by NIST, its employees, or authorized end users includes the automatic inclusion of the NIST Addendum. It clarifies that the act of clicking an "I agree" box or electronically accepting an agreement does not bind the Government, its employees, or any authorized end user without the simultaneous automatic inclusion of this Addendum.

    The NIST Addendum emphasizes that the Agreement is governed exclusively by the Federal laws of the United States of America, and laws of other jurisdictions do not apply. It also limits specific remedies, indemnifications, warranties, liabilities, fines, penalties, fees, and interest charges to those traditionally available in law suits involving the Federal government or as permitted by Federal law.

    Furthermore, the Addendum states that intellectual property created by employees of the Federal government is owned exclusively by the Federal government, with no encumbrances or obligations for licensing or assignment to any other party. It also addresses confidentiality or use of information provisions, which are subject to the Freedom of Information Act and other Federal laws and regulations governing confidential or protected information provided to NIST.

    The NIST Addendum clarifies that only information identified as confidential in writing when supplied to NIST will be treated as confidential. It also highlights that information obtained by NIST is subject to the Whistleblower Protection Act, ensuring consistency with existing statutes and Executive orders relating to classified information, communications to Congress, reporting violations, and whistleblower protection.

    Additionally, the Addendum specifies that only the U.S. Inspector General or other authorized Federal agency may audit NIST. It also includes provisions for any additional terms or conditions, future modifications to the Agreement, or documents incorporated by reference, which are subject to this Addendum.

    The Agreement does not obligate any funds, and the Government is duty and tax-exempt. It also prohibits the assignment or delegation of rights or obligations without the Government's prior approval. The NIST Addendum takes precedence over all other terms and conditions in the Agreement or related documents and survives the termination of the Agreement. The duration of the Agreement is limited to five (5) years.

    Notice of Intent to Sole Source Preventative Maintenance Services for a Gamma Well Counter The Department of Commerce, specifically the National Institute of Standards and Technology (NIST), intends to negotiate a sole source contract with PerkinElmer of Shelton, CT for the procurement of Preventative Maintenance Services for a PerkinElmer Wizard2 Gamma Well Counter. This contract will cover a base year plus four option years for NIST's Physical Measurement Laboratory (PML). The Preventative Maintenance Services are crucial for the continued operation of the gamma well counter, which is the cardinal instrument in NIST's Radioactivity Group. The Radioactivity Group develops and improves metrological techniques for radionuclide standardization and carries out various programs related to environmental measurements, nuclear medicine, radiological instrumentation for security, and radionuclide metrology. The gamma well counter plays a critical role in maintaining low-level secondary radioactivity standards and ensuring the integrity of long-term data acquisitions for radio nuclidic half-life determinations. PerkinElmer is the sole manufacturer and technician authorized to provide the required preventative maintenance services for the instrument. They possess the proprietary knowledge and parts necessary for successful maintenance. No other vendors are capable of providing the required services, and only authorized PerkinElmer technicians can maintain the existing warranty of the system during maintenance. The North American Industry Classification System (NAICS) code for this acquisition is 811219, with a size standard of $20.5 million dollars. The Government will consider responses received by November 6, 2015, to determine whether to conduct a competitive procurement. However, this notice of intent is not a request for competitive quotations, and no solicitation package will be issued. In summary, NIST intends to procure Preventative Maintenance Services for a PerkinElmer Wizard2 Gamma Well Counter to ensure the continued operation and performance of the instrument, which is vital for maintaining radioactivity standards and supporting various research programs. PerkinElmer is the sole provider capable of delivering the required services and maintaining the existing warranty.

    Domestic Origin of Meat Produced for Federal Nutrition Assistance Programs January 2024

    Special Notice: AGRICULTURE, DEPARTMENT OF - AGRICULTURAL MARKETING SERVICE - USDA AMS 3J14 The Department of Agriculture, specifically the Agricultural Marketing Service (AMS), has issued a special notice regarding the domestic origin of meat produced for federal nutrition assistance programs. The notice clarifies that meat products used in these programs must come from animals that are born, raised, and slaughtered in the United States. AMS procures food products of domestic origin for nutrition assistance programs and regularly evaluates the effectiveness of its food purchase programs. The guidelines for procuring beef, pork, lamb, and bison products were found to be unclear, prompting the need for clarification. To ensure compliance with the domestic origin requirement, vendors must not knowingly procure animals from outside the U.S. for use in federal nutrition assistance programs. Additionally, vendors must not knowingly slaughter animals clearly marked as imported to produce meat for these programs. USDA regulations require that imported cattle, bison, swine, and lambs be identified through branding, tattoos, and/or identification tags. AMS will enforce the domestic origin requirement by requiring vendors to include a description of how they will ensure compliance in their technical proposals. This may involve implementing segregation plans or other methods to provide reasonable assurance of compliance. AMS conducts regularly scheduled in-person audits to verify compliance with the technical proposals. If a vendor is found to have violated the domestic origin requirement, they will be required to provide a corrective action and, if necessary, update their technical proposal. Willful violations may result in the vendor being suspended by AMS until they can demonstrate that the issue has been resolved. AMS auditors will not visit feedlots as part of verifying the domestic origin requirement. Audits will be conducted on the premises of the vendor establishment, and it is the vendor's responsibility to ensure compliance. Contracts awarded prior to January 1, 2024, are not subject to the clarified requirement. However, contracts entered on or after January 1, 2024, will be subject to the requirement.
