This Use and Non-Disclosure Agreement (DLA-Aberdeen-26-002) governs the release of technical data and computer software (Data) related to SINCGARS Installation Kits and Components for market research purposes. The Recipient agrees to strict limitations on the use, modification, reproduction, release, performance, display, or disclosure of this Data, which may be marked with government purpose rights, SBIR data rights, limited rights, restricted rights, or special license rights. The agreement mandates that Data marked with government purpose or SBIR data rights only be used for government purposes, not commercial, and requires express written permission from the contractor for disclosure to third parties other than approved subcontractors/suppliers, who must also sign similar agreements. Limited rights data use is restricted as specified in an attachment, while restricted rights software is for market survey responses only, prohibiting reverse engineering or multi-computer use without licensor permission.
