This sole source contracting action is in accordance with Federal Acquisition Regulations (FAR) 13.106-1(2)(b) and 6.303-2 modified to reflect procedures in 13.5 (a)(ii). Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the government, would not be cost or time prohibitive, and would not hinder the mission objectives. The determination not to compete the proposed contract action is solely within the discretion of the Government. Information received will be considered for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding software licensing of this type.
