Heidelberg HEYEX2 Upgrade: Intent to Sole Source SDVOSB Sole Source to Sole OEM-Authorized Distributor

This presolicitation notice announces the Department of Veterans Affairs (VA) Medical Center Providence's intent to award a sole-source, firm-fixed-price contract to L1 Enterprises LLC, a Service-Disabled Veteran-Owned Small Business (SDVOSB). Valued at approximately $27,000, the procurement is for the Heidelberg HEYEX 2 Image Management Platform. This proprietary system is required to operate and integrate the facility’s existing, VA-owned Heidelberg Spectralis ophthalmic imaging system. The scope of work includes a server move, extended cache backend, software protector USB dongle, an HP Z2 G9 workstation, a TB3 conversion kit, OEM-trained installation, clinical and engineering training, and a one-year manufacturer's warranty. Market research confirmed that Heidelberg Engineering’s HEYEX 2 is a proprietary, brand-name-only system, and no compatible third-party alternatives exist to manage the raw imaging data and metadata without degrading clinical care. Heidelberg Engineering designated L1 Enterprises LLC as its sole authorized SDVOSB distributor to the government. Because there is only one authorized distributor, the "Rule of Two" cannot be met for a set-aside. Accordingly, the VA is utilizing a sole-source acquisition under FAR 12.102-1(a) and VAAR 819.7008, supported by an applicable Small Business Administration Nonmanufacturer Rule (NMR) class waiver.
