The Bureau of Indian Affairs issued a Sources Sought Notice for pre-construction risk assessment, asbestos safety, and water intrusion services at the Phoenix Indian Medical Center. This notice is for market research to determine compliance with the Buy Indian Act and set-aside possibilities, not a request for quotes. The NAICS code is 562910 for Remediation Services. Priority will be given to Indian Small Business Economic Enterprises (ISBEEs). Interested firms must submit company information, business category (IEE or ISBEE), a capability statement, and an IHS Indian Economic Enterprise Representation form by March 6, 2026. Firms must also be registered in SAM.

The Indian Health Service (IHS) Division of Acquisition Policy (DAP) requires Offerors to self-certify as an “Indian Economic Enterprise” (IEE) to qualify for contracts under the Buy Indian Act (25 U.S.C. 47). This form, applicable to solicitations, sources sought, and RFIs, mandates that enterprises meet the IEE definition at the time of offer, contract award, and throughout the contract performance period. Non-compliance requires immediate written notification to the Contracting Officer. Eligibility documentation may be requested, and awards are subject to protest. Offerors must also register with the System for Award Management (SAM). Providing false information is a violation of law, punishable under 18 U.S.C. 1001, with false claims subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The form requires the Offeror to explicitly state whether they meet the IEE definition, with signatures from the 51% owner, the certifying individual, and details of the tribal entity, business name, and DUNS number.
