SPECIAL NOTICE / INTENT TO SOLE SOURCE FPSU Cepheid Molecular Analyzer Service and Maintenance

The Billings Area Indian Health Service (IHS) intends to award a sole source, firm fixed-price contract to Cepheid US for service and support of their GeneXpert Molecular Analyzers at the Fort Peck Service Unit in Montana. This base-plus-four-option-year contract, valued at approximately $30,000.00, will run from December 11, 2025, through December 10, 2026, with subsequent option years following a similar schedule. The IHS is pursuing a waiver from competition under FAR 6.103-1, citing Cepheid US as the sole responsible source due to their intellectual property rights over the analyzer. The agency asserts that no other supplies or services can meet their requirements, a determination based on market research. Responses challenging this sole source intent must provide clear evidence that competition would benefit the government, be cost-effective, and not hinder mission objectives related to agency standardization, data center standardization, and network security.
