USNS ARCTIC ROH/DD 2027 - Pre-solicitation

This document is a Use and Non-Disclosure Agreement (NDA) for Government Technical Data (Attachment J-14) associated with solicitation N3220527R6002 for the USNS ARCTIC (T-AOE 8). The agreement governs the access, use, and protection of controlled technical data and computer software provided to prospective offerors. Under this agreement, the offeror commits to utilizing the provided data solely for preparing proposals and executing the subsequent contract. The offeror must comply with all distribution statements, export control regulations, and establish strict organizational access controls. Additionally, the agreement prohibits copying, reproducing, or disclosing the data to unauthorized individuals without written consent from the Contracting Officer. Any third-party vendors or subcontractors must execute a similar flow-down NDA, and their details must be documented within this form. Upon contract award to another party or completion of the contract work, the offeror must return or destroy the data and certify this action in writing to the Contracting Officer within 30 days. Unauthorized disclosures require the offeror to assist the government in data recovery and reimburse any associated costs or damages.
