Commercial Quantitative Respirator fit testing system

This document is an Indian Economic Enterprise (IEE) Representation Form issued by the Department of Health & Human Services, Indian Health Service (IHS). Its primary purpose is to allow offerors to self-certify as an eligible IEE under the authority of the Buy Indian Act (25 U.S.C. 47) and HHSAR 326.601 in response to federal solicitations, sources sought notices, or requests for information (RFIs). To qualify, the offeror must meet the definition of an IEE during three distinct phases: at the time the offer is submitted, at the time of contract award, and throughout the entire duration of contract performance. If eligibility status changes at any point, the contractor is required to notify the Contracting Officer immediately in writing. Contracting Officers reserve the right to demand documentation proving eligibility before awarding a set-aside or sole-source contract. Additionally, successful offerors must be registered in the System for Award Management (SAM). The form warns that submitting false or misleading information to secure a contract under the Buy Indian Act is a federal violation punishable under 18 U.S.C. 1001, with false claims subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The representation section requires the authorized official to declare their IEE status and provide the name of the 51% owner, the federally recognized tribal entity, the business name, and the Unique Entity ID/DUNS number.
