The Indian Health Service (IHS) requires potential contractors to complete a "Buy Indian Act Indian Economic Enterprise Representation Form" for solicitations, sources sought, or RFIs. This form ensures self-certification that the offeror meets the definition of an "Indian Economic Enterprise" (IEE) as defined by HHSAR 326.601, throughout the offer, award, and contract performance periods. Contractors must notify the Contracting Officer immediately if they no longer meet eligibility requirements. Eligibility documentation may be required, and awards are subject to protest. Additionally, successful offerors must be registered with the System for Award Management (SAM). Submitting false or misleading information is a violation of law, punishable under 18 U.S.C. 1001, with false claims subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Offerors must explicitly indicate whether they meet the IEE definition and provide details such as the name of the 51% owner, certifying signature, tribal entity, business name, and DUNS Number.
