This Indian Health Service (IHS) document is a self-certification form for the Indian Economic Enterprise (IEE) Representation under the Buy Indian Act (25 U.S.C. 47). It requires offerors to certify that they meet the definition of an IEE with at least 51% Indian ownership. To qualify for set-aside or sole-source contracts, the enterprise must maintain its IEE eligibility status at three critical stages: when submitting an offer, at the time of contract award, and throughout the entire duration of contract performance. If eligibility status changes at any point, the contractor is obligated to immediately notify the Contracting Officer in writing. Additionally, offerors must be registered in the System for Award Management (SAM). Contracting Officers may request further documentation to verify eligibility, and awards can be protested. Submitting false or misleading information to secure a set-aside contract is a federal violation punishable under criminal and civil fraud statutes, including 18 U.S.C. 1001 and the False Claims Act. The form requires the business name, DUNS number, certifying signature, and the name of the federally recognized tribal entity.
