    The Indian Health Service (IHS) requires potential contractors to complete a Buy Indian Act Indian Economic Enterprise Representation Form. This form serves as a self-certification that the Offeror meets the definition of an “Indian Economic Enterprise” (IEE) as per HHSAR 326.601, in accordance with 25 U.S.C. 47. Contractors must immediately notify the Contracting Officer if they no longer meet the eligibility requirements. Individual Contracting Officers may request documentation to verify eligibility, and awards can be subject to protest if eligibility is questioned. In addition to self-certification, successful Offerors must be registered with the System for Award Management (SAM). The document warns that submitting false or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729 to 3731 and 18 U.S.C. 287.
